Terms of Service

Welcome to LandUseResearch.com ("Land Use Research," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of landuseresearch.com and the research services we provide (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service Is

Land Use Research provides digital information packets that organize publicly available zoning, land use, and related regulatory information for a specific parcel of real property. Our packets are designed to help you prepare for a meeting with your municipal planning department and to help you decide whether to engage licensed professionals for further review.

OUR PACKETS ARE DIGITAL INFORMATION PRODUCTS. THEY ARE NOT:

  • Legal advice
  • Engineering advice
  • Surveying services
  • Architectural advice
  • A substitute for consultation with your municipal planning department
  • A substitute for professional title, environmental, or geotechnical review
  • A guarantee that any particular use, structure, or development is permitted
  • Actionable without municipal verification

You must independently verify all findings with the appropriate municipal authority and qualified licensed professionals before taking any action based on a packet.

2. No Professional Relationship

Using the Service does not create an attorney-client, engineer-client, surveyor-client, architect-client, or any other professional services relationship between you and Land Use Research. We are not a law firm, engineering firm, surveying firm, or architectural firm, and we do not employ or engage licensed professionals to produce reports.

3. AI Disclosure

Our reports are produced using artificial intelligence systems that reference public data sources including municipal codes, GIS systems, FEMA maps, and county records. AI systems can make mistakes, including but not limited to misreading code sections, confusing overlay districts, and missing recent amendments. Our Mode A/B/C system is designed to flag uncertainty, but it is not infallible.

4. Mode A, Mode B, and Mode C

Our packets are classified by our internal confidence system:

  • Mode A: Full coverage with verified data. You are charged the stated price ($99 for Research Packet).
  • Mode B: Partial coverage with verified core data and flagged items requiring municipal verification. You are charged the stated price.
  • Mode C: Insufficient data to produce a confident packet. You are NOT charged.

For Mode A and Mode B packets, a pending authorization is placed on your payment method and captured upon delivery of the packet. For Mode C, the authorization is voided and no charge is made.

5. Digital Goods and Refunds

DIGITAL GOODS POLICY:

Packets are digital information products delivered upon payment. By completing your purchase, you acknowledge that you are receiving a digital good that cannot be returned once delivered. All sales are final upon packet delivery.

Mode C refusals (where we cannot produce a confident packet) are the sole refund mechanism—you are simply not charged. For Mode A and Mode B packets, if you believe your packet contains a material factual error, contact support@landuseresearch.com within 14 days of delivery with specific details and we will review. Goodwill adjustments are at our sole discretion and are limited to cases of verifiable factual error in data we claimed to verify.

6. Limitation of Liability

To the maximum extent permitted by law, our total cumulative liability to you for any and all claims arising out of or related to the Service or any report is limited to the amount you paid for the specific report at issue, or one hundred dollars ($100.00), whichever is greater.

We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost data, property devaluation, construction costs, permit denial costs, attorneys' fees, or opportunity costs, even if we have been advised of the possibility of such damages.

You acknowledge that the fees you pay reflect this limitation of liability and that we would not provide the Service without it.

7. No Warranty

The Service and all reports are provided "as is" and "as available" without warranty of any kind, whether express, implied, or statutory. We disclaim all warranties, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and timeliness.

Zoning codes, ordinances, overlay districts, and municipal interpretations change frequently. A report reflects data as of its generation date and may become outdated at any time.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Scrape, harvest, or redistribute reports or site content
  • Reverse engineer the Service or attempt to extract underlying data sources
  • Use the Service to generate reports for resale or redistribution without a written license from us
  • Circumvent the Mode A/B/C classification system
  • Submit false or misleading information
  • Interfere with or disrupt the Service

Reports you purchase are for your personal or internal business use. You may share a report with your attorney, architect, engineer, planner, lender, agent, or counterparty in a transaction without additional charge. Commercial resale or public redistribution requires written permission.

9. Intellectual Property

All content on the Service, including the report format, methodology, software, and site design, is owned by Land Use Research or its licensors and is protected by copyright and other laws. The factual data within reports (zoning designations, code sections, etc.) is public information and not owned by us, but our organization, selection, and presentation of that data is proprietary.

You are granted a limited, non-exclusive, non-transferable license to use reports you purchase for the purposes described in Section 8.

10. Payment

Payments are processed by Stripe, Inc. By providing payment information, you authorize us to charge the applicable fee. You are responsible for any applicable taxes. Authorization holds for Mode C reports are automatically voided, typically within 7 days. If a void does not process correctly, contact support@landuseresearch.com and we will resolve it immediately.

11. Accounts

Our Service does not require an account for one-off report purchases. If you choose to create an account via Google SSO through Clerk, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

12. Changes to the Service and to These Terms

We may modify the Service or these Terms at any time. Material changes will be posted to this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance.

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your rights under these Terms end, but Sections 6, 7, 9, 14, and 15 survive.

14. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the State of Nevada, without regard to conflict of laws principles. You and Land Use Research agree that any dispute will be resolved exclusively in the state or federal courts located in Clark County, Nevada, and both parties consent to the personal jurisdiction of those courts.

15. Indemnification

You agree to indemnify and hold harmless Land Use Research, its owners, operators, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your reliance on a report in a manner inconsistent with these Terms.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Land Use Research regarding the Service.

17. Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect.

Privacy Policy

This Privacy Policy describes how Land Use Research ("we," "us," or "our") collects, uses, and protects personal information when you use landuseresearch.com and our Service.

1. Information We Collect

When you use the Service, we may collect:

Information you provide:

  • Property address and property-related details you enter to generate a report
  • Your email address
  • Your name (if provided at checkout)
  • Payment information (processed by Stripe — we do not store full payment card numbers on our servers)
  • Any information you send us via email support

Information collected automatically:

  • IP address
  • Browser type and version
  • Device type
  • Pages visited and time spent
  • Referring website
  • Cookies and similar tracking technologies (see Cookie section below)

Information from third parties:

  • If you sign in via Google SSO (Clerk), we receive your name, email, and profile image from Google
  • Stripe provides us transaction confirmations but not full card data

2. How We Use Information

We use the information we collect to:

  • Generate and deliver your report
  • Process payments and manage Mode A/B/C charging and refunds
  • Send you report delivery emails and service-related communications
  • Improve the Service and expand jurisdiction coverage
  • Detect fraud, abuse, and violations of our Terms
  • Comply with legal obligations

We do not sell your personal information. We do not share your information with third parties for their marketing purposes.

3. Third Parties We Work With

We use trusted service providers to operate the Service:

These providers are bound by their own privacy policies and process your data only on our behalf.

Note on OpenAI: Property addresses and report prompts are processed by OpenAI's API. We use API access, which per OpenAI's data usage policy is not used to train their models.

4. Data Retention

  • Generated reports are stored for 30 days from delivery to allow you to access them
  • Order records (email, transaction ID, jurisdiction, tier) are retained for 7 years for tax and legal compliance
  • Account records (if you created an account) are retained until you request deletion
  • Aggregated analytics data is retained indefinitely

5. Your Rights

Depending on your state of residence, you may have the following rights:

  • Right to access: Request a copy of personal information we hold about you
  • Right to delete: Request deletion of your personal information, subject to legal retention requirements
  • Right to correct: Request correction of inaccurate information
  • Right to opt out of sale: We do not sell personal information, but you may formally confirm this by contacting us

To exercise any of these rights, email privacy@landuseresearch.com with your request.

6. Nevada Residents

Under Nevada Revised Statutes Chapter 603A, Nevada residents have the right to submit a verified request directing us not to sell certain personal information. We do not currently sell personal information as defined by NRS 603A. To formally submit a "Do Not Sell" request, email privacy@landuseresearch.com with the subject line "Nevada Do Not Sell."

7. Texas Residents

Under the Texas Data Privacy and Security Act (TDPSA), Texas residents have rights to access, correct, delete, and port their personal data, and to opt out of targeted advertising, sale of personal data, and certain profiling. To exercise these rights, email privacy@landuseresearch.com.

8. California Residents

If you are a California resident, additional rights may apply under the California Consumer Privacy Act (CCPA/CPRA). Land Use Research currently does not market to California and does not knowingly sell personal information. To exercise California privacy rights, email privacy@landuseresearch.com.

9. Children's Privacy

The Service is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided information to us, contact us and we will delete it.

10. Cookies

We use cookies and similar technologies for:

  • Essential functionality (authentication, checkout)
  • Analytics (understanding how the Service is used)
  • Fraud prevention

You can control cookies through your browser settings. Disabling essential cookies may prevent the Service from working correctly.

11. Security

We use industry-standard security measures including HTTPS encryption, secure payment processing via Stripe, and access controls on our systems. No system is perfectly secure, and we cannot guarantee absolute security.

12. International Users

The Service is operated from the United States and intended for users locating U.S. parcels. If you access the Service from outside the U.S., you consent to your information being transferred to and processed in the U.S.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted to this page with an updated "Last updated" date. Continued use after changes constitutes acceptance.
